Notification of Legal Action Policies

 
The services provided by PharmServ Solutions’ employees to our clients require compliance with various federal and state laws and regulations, including but not limited to those regarding licensure and Medicare/Medicaid. PharmServ Solutions has a duty to provide its clients with Pharmacists who can legally and properly perform the services contracted for, without subjecting PharmServ Solutions or its clients to penalties. As such, PharmServ Solutions requires employees to notify it whenever they are
impacted by any of the circumstances discussed below. The Company will evaluate the factual circumstances underlying the legal actions listed below, and will make a decision regarding what employment actions to take as a result, which may include termination of the employment relationship. Failing to provide timely notice as required by this policy may result in disciplinary action, up to and including the termination of employment.
Convictions. Any employee who has been convicted of, pled guilty to, or pled no contest to, a drug or alcohol related crime, or any felony, must notify PharmServ Solutions d/b/a PharmServ Staffing of such no later than three (3) calendar days after the conviction or plea is ordered or entered, whichever occurs first.
Arrests. Any employee who has been arrested for a drug or alcohol related crime, or any felony, must notify PharmServ Solutions d/b/a PharmServ Staffing of the arrest no later than five (5) calendar days after the arrest, or sooner if the employee is unable to report for scheduled work due to the arrest. The Company will keep in mind that an arrest does not constitute a conviction, and that the presumption of innocence is part of the American justice system, when making decisions regarding employment actions to take as a result of an arrest.
Investigations and Outcomes. Any employee who has been notified that he or she is under investigation by any state or federal agency, including but not limited to the Office of Inspector General or a state board of pharmacy, must notify PharmServ Solutions d/b/a PharmServ Staffing of the investigation no later than five (5) calendar days after he or she becomes aware of such an investigation and within three (3) calendar days after he or she becomes aware of the outcome of such an investigation, whether the outcome is exclusion, debarment, or any lesser finding.
